We presented ourselves to others as husband and wife and people that we know consider us to be. I have used his last name on things.We have never filed taxes together though, I have been making all the money for a whilr now while he had stayed at home with our kids. Can we be considered common law married even though we have never filed a declaration? He has an ex gf who he lived with 6 years ago but they have a child together. The filed together as married for 6 years on tax returns for easier tax purposes though they were not legally married and they never told anyone like friends and family they were married or did she take his last name or anything like that. <br />Everyone knew them as boyfriend and girlfriend and then they broke up. I've recently been speaking to my ex of 6 years and he claims we were common law married. He said he never pursued a divorce from me but that he could have. The Sanger police said that everything in the house and the house (which is in his name) is half mine, half his. I told them I didn't agree. We never claimed to be married. My name was never on any of the bills even though I had been paying half the bills and later all the bills plus his personal bills as he ran out of money. I asked the police about common law. I said it was my understanding that you either sign something stating your common law or you claim you're married. Neither was done.
